“Samuel’s death is noticed on the Hingham records as follows: ‘Hon. Samuel Thaxter, late one of His Majesties Council and Colonel of this Regiment, being in the 76 yr of his age, dyed.’ Col. Thaxter was a man of marked ability, and one of Hingham’s most prominent and influential citizens; magistrate; delegate to the General Court 1697, and from 1708 to 1712 inc., also from 1711 to 1718 inc.; an assistant, and otherwise distinguished in pulic posts; selectman 1695, 1705, 1706, and 1717. Resided on the paternal homestead, North St.”33

Theophilus purchased from his aunt, widow of Mathias Briggs, the latter’s homestead near Pear Tree Hill.7

Theophilus and Mary resided on Main St., South Hingham. He was selectman 1697, 1707, and 1715, and representative 1702-04, 1707 and 17333.

Will: The will of Theophilus Cushing, dated 3 Jan 1717/18, gives 'to wife Mary, thirty-two shares in the second part of 3d division in Cohasset; also land at 'Planters' Hill;' my quick stock, all my movables, and the improvement of my whole estate while she remains a widow; afterwards to go to sons Theophilus and Seth when they become of age. To daughter Deborah £100; to son Nehemiah land in Abington, and the release of a bond for money lent him; to son Adam land and buildings formerly purchased of William Sprague, sen r.; to son David land purchased of Samuel Stodder, also the lot purchased of my brother Samuel Thaxter; to son Abel house and land I purchased of William Sprague, Jr., lying near 'Page's Bridge;' to son Theophilus my dwelling-house, barn, and land on the west side of the road, and land at 'Wakely's Marsh;' to son Seth land and other valuables; and the sons are to pay £100 each to their sister Deborah;' w. Mary executrix.

(1092) (ca 1627-31 Mar 1708) & Sarah Hawke (1388) (ca 1641-9 Mar 1678/9).33 Born on 26 Dec 1663 in Scituate, MA.3 At the age of <1, Thomas was baptized on 3 Apr 1664.48 Thomas died in Boston, MA, on 3 Oct 1740; he was 76.48

Thomas lived in Boston. In 1690 he was admitted to the Second Church there. He was Ensign in 1691, and a member in 1709 of the Ancient and Honorable Artillery Company; Selectman of Boston in 1723, and representative of the King’s State Council from 1724 to 1725. In 1725, he was one of the opponents of the explanatory Charter of King George I.48

“John resided in Scituate, Mass. He was a deputy to the General Court in 1692; Chief Justice of the Inferior Court of Plymouth, from 1702 to 1710; representative member for Massachusetts of the Governor’s Council, from 1708 to 1728; and Judge of His Majesty’s Superior Court of Judicature of Massachusetts from 1728 to his death in 1737. The Superior Court of Massachusetts, from its foundation in 1692 until its overthrow by the Revolution, had 33 Justices, the Bench consisting of five members. Among these were John Cushing 1728, his son John Cushing Jr., and his grandson William Cushing. Rev. Josiah Cotton of Plymouth says of him: ‘He was a gentleman well versed in law, the life and soul of our Court while he continued in it, a man in the main of justice and integrity.’ In 1723 he was Lieut. Col. of the Plymouth Regiment, which at that time probably embraced all the local militia of the County.”48
