Will: Prouty's Will
In the name of God Amen, this second day of May in the year of
our Lord one thousand eight hundred and five, I, Isaac Prouty of
Spencer in the County of Worcester and Commonwealth of
Massachusetts Yeoman: being in a declining state of health but
thanks be to God of a sound disposing mind, and being called
upon by the Providence of God to settle my affairs in the world,
do make and ordain this my last will & testament that is to say,
First of all I give and recommend my Soul into the hands of God
who gave it and my body to the Earth to be buried in a decent
Christian burial at the direction of my executor in good hope of
receiving it again at the glorious resurrection by the power and
mercy of God to a glorious immortality through Jesus Christ. And
as touching such worldly Estate with which it hath pleased God to
bless me with, I give demise and dispose of it in the following
manner and form, that is to say,
First I will to my beloved wife Priscilla Prouty the use and
improvement of my dwelling house during her natural life or so
long as she shall remain my widow & a comfortable, good and
convenient maintenance in every respect to be done and
performed by my executor, and fifteen Dollars yearly to be paid
her by my executor during the term aforesaid, and all my
household furniture to be at her disposal.
I will to my Daughter Prissa Prouty a good and comfortable
maintenance during her natural life to be done and performed by
and at the expense of my executor or so long as she remains in an
unmarried state.
I will to my Daughter Sage Dane* the sum of Forty Dollars to be
paid in six years after my decease and without interest.
I will to my Daughter Avis Prouty the sum of Two hundred and
fifty Dollars to be paid in Seven years after my decease, with
annual interest.
I will to my Daughter Betsy Prouty the sum of Two hundred and
fifty Dollars to be paid in Eight years after my decease with annual
Interest.
I will to my Son Elisha Prouty the sum of Two hundred Dollars,
one hundred of said Sum to be paid in one year after my decease
and the remainder in two years and without interest.
I will to my deceased Son Elijah Proutys two heirs namely Pliny
Prouty and Artemas Prouty the sum of Fifty Dollars each to be
paid them whenever they arrive to the age of Twenty one years.
I will to my son Joseph Prouty the sum of Sixty Dollars to be paid
in three years after my decease without Interest.
I will to my son Jesse Prouty the sum of Sixty Dollars to be paid in
four years after my decease without Interest.
And the above legacies are to be paid to the final legalees by my
executor as above set forth.
And I also will to my Son Thomas Prouty all my real and personal
Estate of what name or nature whatever that I have not heretofore
willed, to enable him to the just payment of all my just debts and
for the payment and fulfillment of this my will as above specified
as well as for the love I bear to him, and I do hereby constitute
and appoint him the said Thomas Prouty sole executor to this my
last Will and Testament, and I do hereby revoke and dissolve all
and every other former Instrument, Will legacy or bequeath,
certifying and confirming this and no other to be my last Will and
Testament.
Signed, Sealed, published and declared by the above named Isaac
Prouty to be his last Will and Testament, in the presence of us
who have hereunto subscribed our names as witnesses in the
presence of the Testator.

So all people to whom these Presents shall come, Nathaniel Paine
Esq. Judge of the Probate of Wills & within & for the County of
Worcester within the Commonwealth of Massachusetts Sendeth
greetings.
Know ye that on the fourth day of June Anno Domini 1805, the
Instrument hereunto annexed perporting the last Will and
Testament of Isaac Prouty late of Spencer in the County of
Worcester deceased was presented for Probate by Thomas Prouty
the Executor therein named, then present Joseph Garfield and
Nathan Prouty two of the witnesses thereto subscribed, who made
oath that they saw the said Testator Sign, Seal and heard him
declare the said Instrument to be his last Will and Testament, and
that they with Benjamin Drury Esq. Did write their names together
as witnesses to the execution thereof in the said Testators
presence; and that he was then, to the best of their Judgement of
sound disposing mind and memory.
I do therefore Prove, approve and allow of the said Instrument as
the last will and Testament of said Deceased, and commit the
administration thereof in all matters the same concerning and of
his Estate whereof he died issued and possessed in said county
unto Thomas Prouty, the before named executor well and freely
to execute said Will and to administer the Estate of said Deceased
according thereto who accepted said trust and hath given bond to
pay the Debts and legacies and to tender an account of his
proceedings when thereunto lawfully required. In testimony
whereof I hereunto set my hand and Seal of office the Day and
year above written.
