Distribution of the estate of Sarah M. Benham

Estate of Sarah M. Benham, late of Oxford in said district, deceased.
Upon the settlement of the administration account of said estate, there remains for distribution in the hands of the administrator the sum of ($600) six hundred dollars, in real estate only- and the said real estate being found to be ancestral wholly – and derived as appears by the records of said town of Oxford, from John L. Fairchild, the father of the deceased in part, and in part from Clara Bunnell, the wife of John L. Fairchild, and mother of said deceased. Sarah M. Benham – who is also found to have no issue by birth, neither father or mother, brother or sister now living --- and there being to Abraham Fairchild who was the father of said John L. Fairchild one son and one daughter and only two children of said Abraham who have legal heirs or representatives now living – viz. Stephen Fairchild, deceased, whose sole heir and legal representative is Abraham F. Fairchild of Dauphin Co., Pa. and Rachel Stevens, deceased, represented by Charles C. Jackson of Bridgeport, Conn., and Frederick S. Jackson of Danbury, Conn., children of Anna Maria Stevens Jackson, dec’d., and legal heirs, and the only representatives of Rachel.
And there being to Reuben Bunnell, the father of said Clara Bunnell, mother of the deceased Sarah M. Benham, two sons and two daughters, and all deceased, viz. Horace Bunnell and Charles Bunnell, sons, and Ruth Ann Hodge + Lavinia Hitchcock, daughters – four descendants in all, who are now represented by living + legal heirs, as follows, viz. Ruth Ann Hodge by Albert L. Hodge of Roxbury, Conn.
Lavinia Hitchcock by Vantile Hitchcock and Sarah Butt, both of Canfield, Mahoning Co., Ohio, Jane Merwin of Palmyra, Portage Co., Ohio, Julia Platt of Warren, Trumbull Co., Ohio, Ruth A Hunt of Hartsgrove, Ashtabula Co., Ohio, Rebecca Wilber of Eaton Rapids, Eaton Co., Mich., George Hitchcock and Frederick Hitchcock of Medina, Medina Co., Ohio, Jabez Hitchcock of Washington, Washington Co., Iowa, and by the children of her deceased daughter Clara Warner, viz. Helene A Justice of Torrington, Mahoning Co., Ohio, Rose Warner of Oberlin, Lorain Co., Ohio, and Charles W Warner of Shawville, Lorain Co., Ohio, and by the children of deceased daughter Caroline Hunt viz. William Hunt of Abilene, Dickinson Co., Kansas, and Elisha M. Hunt of Hartsgrove, Ashtabula Co., Ohio.

Ordered that the estate be distributed among the said heirs, according to law – and to the several heirs of the ancestors from whom it was derived – And this court appoints Charles H. Butler, Nelson B. Williams, and Elger [obscured] N.F. Wilcockson, Esquires, disinterested and judicious persons, to distribute the same according to law, and return make to this court – by Order of Court

To the Probate Court for the District of Oxford
Estate of [obscured name] Sarah M. Benham late of Oxford in said district deceased.
The subscribers distributors on said estate having been duly sworn, have set out and distributed the same in accordance with law, as follows, viz. Of the real estate of said Sarah M. Benham, accruing to her from a title to the same derived from the estate of her father John L. Fairchild, deceased, on his side, we have set to his nearest of kin in default of her issue and as found by the Court, viz. to Abraham F. Fairchild of Dauphin Co., Pa., an equal and undivided one half interest in the same, and to Charles C. Jackson of Bridgeport, Conn., and Frederick S. Jackson of Danbury, Conn., to each of the last mentioned an equal and undivided one fourth interest in the same said real estate of said Sarah M. Benham, consisting as it appears on record in the mutual distribution of the estate of John. L. Fairchild – and as set to Sarah M. (Fairchild) Benham of two tracts or parcels of land, the first track containing twenty acres more or less on the east of the turnpike road, and the line of which commencing at the northwest corner of said track runs easterly by land of [illegible] Tucker and E.M Chatfield to the north east corner of said track, thence Southerly by said Chatfield to said Chatfield’s south east corner, then still southerly by the fence and land of A.B. Hinman to a heap of stones on the junction of two stone walls about twenty feet westerly from a large high rock in the pasture lot, thence westerly in line with land of A.B. Hinman and the land of N.J. Werlton and a passway, westerly on the Oxford Turnpike.
The second track contains sixteen acres more or less opposite the last residence of the deceased, and on the westerly side of the Turnpike, the line commencing at a small hickory tree, standing by the turnpike, north of the mill, thence westerly and southerly in a line with land of Wales Wheeler’s wife, to a heap of stones on a flat rock, a bounds of Ransom Hudson, thence southerly in a line with Hudson’s land to the south west corner of the land to the south west corner of the land herein described, thence easterly by land of Albert Dutton and A.B. Hinman to Little River, thence by said river and the turnpike to the first mentioned bounds. And the estimated valuei of said estate hereinbefore described is at a fair valuation $450 dollars, 2/4 of which value we set to Abraham F. Fairchild, and 1⁄4 to each of the aforesaid Jackson heirs herein named.
Of the rest and comprising the entire residue of the said real estate, consisting of that portion of the real estate of Sarah M. Benham, the titles to which accrued to her from Reuben Bunnell’s estate through her mother Clara (Bunnell) Fairchild, and described in a mutual distribution by her heirs recorded in Oxford town records vol. 19 page 280 as follows, viz. “a small piece of land adjoining the dwelling house, beginning in front of the dwelling house at a point by Little River, thence up the River to land of Sanford, thence easterly by line of Sanford and Tucker to a heap of stones at the north east corner of the garden,
thence southerly to a heap of stones a divisional Bounds between the said Sarah M. Benham and George A. Fairchild, thence westerly following the range of the south end of the old shop to a point in the upright part of the south end of the dwelling house, thence northerly following in a line with the east end of the upright part of the dwelling house to the south side of the Buttery door, thence westerly following the south side of the buttery to the door by the kitchen thence southerly between the north bed room and the north side of the dwelling house, thence westerly and southerly with the dwelling house to intersect George A’s line in front of the dwelling house standing on said land.” Also the west half of the barn yard and the half of all the buildings connected and described in said distribution of Sarah M Benham + George A Fairchild recorded as above stated.
We estimate the value of the last described track with all its rights and privileges to be worth the sum of $150. And in making distribution of said tract, and halves of all the buildings with the rights pertaining, we apportion the same, in three thousand, six hundred and ninety-six equal and undivided shares, of which we set to the heirs of Ruth Ann Hodge, viz. to Albert L. Hodge 924 shares or one fourth of the whole number of said shares.
We set to the heirs of Lavinia Hitchcock one fourth of the whole number of said shares, viz we set to –

Benham the deceased and as stated in a mutual distribution of ancestral estate which fell to her jointly and as is recorded on the Land Records of Oxford vol 19 Pages 280 + 281.

Aft Apr 1866 Sarah M. married Washington Benham, son of Elihu Benham (ca 1777-19 Feb 1862) & Esther Griffin (ca 1781-30 Jun 1841). Born ca 1812 in Connecticut. Washington died in Beacon Falls, CT in 1889. Buried in Pinesbridge Cemetery, Beacon Falls. Occupation: Joiner, farmer, carpenter.

Washington first married Adaline Judd, second Elizabeth Miller, third Sarah Fairchild, and fourth Sarah.
