    Asks Permission to Deed His Own Estate
    Romance of a Rich Man Who Married Farmer's Pretty Daughter
    Because no Children Came His Millions May Go Into Other Hands
New York, Jan. 10.--The affairs of Henry Astor are always interesting says the Sun Today, because he chose to forfeit his share of the Astor millions and drop out of the fashionable world, a quarter of a century ago, to make a love marriage in opposition to the wishes of his family.
    He is the grandson of the original John Jacob Astor, the only surviving son of William B., a brother of the late William Astor and of the late John Jacob Astor, and an uncle of William Waldorf Astor and the present John Jacob Astor.
    Because of that long ago romance his affairs were in court yesterday, before Justice Ingraham of the Supreme Court.
    Henry Astor always like country life.
    Twenty0four years ago he was managing an Astor farm at Red Hook. His head farmer had a pretty daughter, Malvina Dineheart, and Henry Astor married her. Though his family resented it, he was not left altogether without means.
    There was a large provision for him under his grandfather's will.
    On Feb. 15, 1869, which was before his marriage, Henry made a trust deed covering all his possessions, of which trust Charles P. Southmayd and Henry's brothers, John, Jacob and William, were the first trustees.
    The trustees were to hold the estate during Henry's life, with power to sell, lease and repair the properties and to pay taxes, and were to give the income to him. He was to have the right to dispose of the property by will among his own children, or to disinherit any of them, if he wished. If he died before his wife, she was to have one-third of the trust income during her life. If he died without issue, the property was to go tho his brothers and sisters or their issue, except that John Jacob Astor and his issue were to get no part of it. His brother William and his sisters, Emily Ward and Alice Cary, all deceased, have left issue.
    The trust property include a one-third interest in the Astor House, subject to the life estate of William Astor, and of 119 other parcels of real estate.
    Provided for in this way, Henry Astor took his wife and her kin to West Copake, in Columbia county, and settled down within sight of the spot where New York, Connecticut and Massachusetts join.
    He bought farms for all his kin and one for himself, and a settlement called Astorville has grown up there. There they have lived and prospered for 25 years.
    Mr. Astor's habits are simple, and his moneys have accumulated, but he has no children to inherit them.
    In 1880 his trustees sold his interest in the Astor House to his brothers for $553,333.33. And they have sold $50,000 worth of other property, all with Henry's consent. Trustees John Jacob and william Astor are dead. James F. Chamberlain and Franklin H. Delano, who succeeded them, resigned last April, with Trustee Southmayd, appointing in their places Alfred L. White, Henry Lewis Morris and Charles A. Peabody, Jr.
    The late trustees applied to the court to have their accounts and this was done yesterday.
    With money which had come into their hands they have bought properties at 148 West 46th st. 884 8th av., 488 8th av., 607 8th av., 704 3d av., 503 8th av., at the southwest corner of 8th av. and 37th st., and at 150 West 46th St.
    The net income ot the trust estate is reported to be $1,077,017.
    While the accounting was pending Henry Astor and his wife asked the court for a construction of the deed of trust. They also asked:
    That it may be adjudged and determined that the defendant, Henry Astor, has and shall have an equitable and legal right and power to devise, transfer, and make title selection by will or otherwise of the said real estate unsold.
    It was understood that in asking for this relief Mr. Astor was chafing under the clauses seem to prevent him from deciding to whom his property shall go. He could only select which of his children should get it, and the fact that he has no children leaves the principal apparently absolutely without selection to his brothers and sisters (or their issue), excepting John Jacob Astor.
    Justice Ingraham refuses to pass on this claim of Mr. Astor for a construction of the trust deed on the ground that it is not relative to the suit of the former trustees for an accounting. He says that such an adjudication may be sought by Mr. Astor in a separate action for that purpose.
